These Terms of Service ("Terms") govern your access to and use of the website at probablycomputers.com (the "Site"), operated by Probably Computers (Pty) Ltd, 15 Kruger Ave, Nestpark, Bapsfontein, Gauteng, South Africa ("Probably Computers", "we", "us", "our").

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.


1. Nature of the Site

The Site is an informational and marketing website. It describes Probably Computers' consulting and infrastructure-automation services, provides contact information, and allows prospective or current clients to submit enquiries through a contact form.

The Site does not provide software-as-a-service, create accounts, process payments, or deliver services directly. No contractual engagement for services is formed through the Site itself.


2. Acceptance of Terms

By accessing the Site, you confirm that:

  • Where you use the Site on behalf of an organisation, you have authority to bind that organisation to these Terms.

We do not guarantee a response to every submission, and submission of the contact form does not create any contractual obligation on either party.


6. Engagement Services Are Governed Separately

The Site describes the types of technology consulting and infrastructure-automation services Probably Computers provides. If you engage us for services, those services will be governed exclusively by a separate signed commercial agreement (typically a Statement of Work or Master Services Agreement) between you and Probably Computers.

These Terms do not govern service engagements. In the event of any conflict between these Terms and a signed engagement agreement, the signed engagement agreement prevails.


7. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by South African law, Probably Computers makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of the Site's content.


8. Limitation of Liability

To the fullest extent permitted by applicable law, Probably Computers and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site.

Our total liability to you for any claim arising from your use of the Site (excluding liability that cannot be excluded by law) is limited to ZAR 1,000 (one thousand Rand).

Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded or limited under South African law.


9. Third-Party Services and Links

The Site embeds a Google Maps component to display our office location. Your use of Google Maps through the Site is subject to Google's own terms of service and privacy policy.

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or reliability of any linked sites. Links do not constitute an endorsement.


10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of South Africa.
